Terms of Service

1. Acceptance of Terms
By accessing or using the ProScore website at proscore.ca (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and ProScore (“we”, “us”, “our”), operated from Barrie, Ontario, Canada.
2. Description of Service
ProScore is a contractor intelligence platform that aggregates publicly available data from 15+ verified sources to generate trust scores for contractors across Ontario. The Platform provides homeowners with contractor information, trust scores, and the ability to request quotes. Contractors may claim their profiles, manage their business information, and subscribe to paid plans for enhanced features.
3. User Accounts
a) Contractor Accounts
- To claim a business profile, you must verify your identity via email verification code.
- You are responsible for maintaining the security of your account credentials.
- You must be authorized to represent the business you are claiming.
- You agree to provide accurate and current business information.
- One account per business. Duplicate or fraudulent claims may result in account suspension.
b) Homeowner Use
- Homeowners may browse the Platform, view contractor profiles, and submit quote requests without creating an account.
- By submitting a quote request, you consent to your contact information being shared with the selected contractor.
- Reviews submitted must be truthful and based on genuine service experiences.
4. Subscription Billing
- ProScore offers subscription plans: Verified ($10 CAD/year), Pro ($49 CAD/month), and Elite ($149 CAD/month).
- All payments are processed securely through Stripe. Prices are in Canadian dollars and may be subject to applicable taxes.
- Subscriptions renew automatically at the end of each billing period unless cancelled.
- You may cancel your subscription at any time through your billing dashboard. Access to paid features continues until the end of your current billing period.
- Refunds are issued at our discretion. Contact billing@proscore.ca for refund requests.
- We reserve the right to change pricing with 30 days’ notice. Existing subscribers will be notified via email.
5. Trust Scores & Data
- ProScore trust scores are generated algorithmically from publicly available data sources and are provided for informational purposes only.
- Trust scores do not constitute an endorsement, recommendation, or guarantee of any contractor’s work quality, reliability, or suitability.
- The scoring methodology is proprietary. Specific algorithm parameters, weights, and calculations are trade secrets and are not disclosed.
- Contractors may not manipulate or attempt to artificially inflate their trust scores. Detected manipulation may result in score penalties or account suspension.
- We strive for accuracy but cannot guarantee that all data is current or error-free. Contractors may request corrections to inaccurate information.
6. Content & Intellectual Property
- All Platform content, including trust scores, design, code, and branding, is owned by ProScore and protected by Canadian intellectual property laws.
- Contractors retain ownership of photos and content they upload but grant ProScore a non-exclusive, royalty-free license to display such content on the Platform.
- Reviews submitted by homeowners become Platform content. We reserve the right to moderate, edit, or remove reviews that violate our guidelines.
- You may not scrape, reproduce, or redistribute Platform data without written permission.
7. Prohibited Conduct
You agree not to:
- Submit false, misleading, or fraudulent information, including fake reviews.
- Impersonate another business or individual.
- Attempt to access another user’s account or data without authorization.
- Use automated tools to scrape, harvest, or collect data from the Platform.
- Interfere with the Platform’s operation, security, or infrastructure.
- Use the Platform for any unlawful purpose.
8. Limitation of Liability
To the maximum extent permitted by law, ProScore and its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to: loss of profits, business opportunities, or data; reliance on trust scores or contractor information; or interactions between homeowners and contractors facilitated by the Platform.
ProScore acts as an information platform, not as a contractor, employer, or guarantor. We do not employ contractors, supervise their work, or guarantee the outcome of any service engagement. Homeowners are responsible for their own due diligence when hiring contractors.
Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid to ProScore in the 12 months preceding the claim, or $100 CAD, whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless ProScore from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: your use of the Platform; your violation of these Terms; your violation of any third-party rights; or content you submit to the Platform.
10. Termination
- We may suspend or terminate your account at any time for violation of these Terms, with or without notice.
- You may close your contractor account by contacting contact@proscore.ca.
- Upon termination, your right to use paid features ceases immediately. Your public business listing may remain on the Platform as unclaimed.
- Active subscriptions will not be refunded upon termination for cause.
11. Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute shall be submitted to the courts of the Province of Ontario, and you consent to the exclusive jurisdiction of those courts.
12. Modifications
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated revision date. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. For paid subscribers, material changes to billing terms will be communicated via email at least 30 days in advance.
